Terms of Service

These Terms of Service ("Terms") govern your use of PlumAI ("the Service"), operated by a company registered under Portuguese law ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What PlumAI Does

PlumAI is an AI-powered content creation platform. It helps you discover trending topics, generate articles, translate content, create AI images, and manage your content workflow. The Service includes a web application and, for qualifying plans, an API.

2. Accounts

You must create an account to use PlumAI. You sign in via Google OAuth. You are responsible for all activity on your account and must notify us immediately if you suspect unauthorized access.

You must be at least 16 years old to create an account. One person or company may not maintain more than one account.

3. Subscriptions and Payments

PlumAI offers three paid plans: Starter, Pro, and Ultra. There is no free tier. All plans are billed monthly or annually through Stripe. Prices are listed in US dollars (USD) and may be subject to VAT depending on your country.

Subscriptions renew automatically unless you cancel before the next billing date.
You can cancel anytime from your account settings or the Stripe billing portal. Cancellation takes effect at the end of your current billing period.
We may offer promotional discounts (e.g. 50% off for the first 3 months). These are applied automatically and revert to the standard price after the promotional period ends.
We do not offer refunds by default. If you believe a charge was made in error, contact us within 14 days.

We reserve the right to change pricing with 30 days notice. Existing subscribers will be notified by email before any price change takes effect.

4. Usage Limits

Each plan includes a monthly article generation limit (Starter: 15, Pro: 50, Ultra: 200). Topic discovery, translations, and AI image generation are included at no extra charge. Usage counters reset at the start of each billing period. Unused articles do not roll over.

5. Content Ownership

Your content: You own the articles, topics, and other content you create or generate through the Service. We claim no ownership over your content.

License to us: You grant us a limited license to store, process, and transmit your content solely to provide and improve the Service. This license ends when you delete your content or close your account.

AI-generated content: Articles and images produced by the Service are generated by AI models. You are responsible for reviewing all generated content for accuracy before publishing. We do not guarantee that AI-generated content is factually correct, free of bias, or suitable for any specific purpose.

6. Acceptable Use

You may not use PlumAI to:

Generate illegal, harmful, defamatory, or fraudulent content
Create content that infringes on the intellectual property of others
Distribute spam, malware, or phishing material
Attempt to access other users' accounts or data
Reverse-engineer, scrape, or abuse the Service or its API
Resell API access or generated content as a competing service
Generate content promoting hate speech, violence, or discrimination

7. API Access

API access is available on the Pro and Ultra plans. You must keep your API keys confidential. You are responsible for all requests made with your keys. We may enforce rate limits and suspend access if we detect abuse.

8. Availability and Warranties

The Service is provided "as is" and "as available." We make no warranties, express or implied, regarding uptime, accuracy, or fitness for a particular purpose. We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of revenue, data, or business opportunities. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account if you violate these Terms or engage in activity that harms the Service or other users. You may close your account at any time. Upon termination, your right to use the Service ends immediately. We will retain your data for 30 days after account closure, after which it will be deleted.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 14 days before they take effect. Continued use of the Service after the effective date means you accept the updated Terms.

12. Governing Law

These Terms are governed by the laws of Portugal. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Lisbon, Portugal, without regard to conflict of law principles.
